My visa was refused — what are my options?

Don’t assume the decision is final. Depending on what your refusal letter says, there are usually four possible routes:

Administrative review

asking the Home Office to correct a caseworking error

Appeal

An independent hearing before an immigration judge

Judicial review

Challenging an unlawful decision where there's no appeal or review right

Fresh application

Sometimes the fastest and strongest option

Administrative review

An administrative review is a formal request asking the Home Office to reconsider a decision that contains a caseworking error. It’s a review of the original decision based on the evidence already submitted — you can’t add significant new evidence. It applies mainly to points-based routes such as work and study visas. Deadlines are strict (usually 14 or 28 days depending on where you applied), so act quickly.

Appeal to the First-tier Tribunal

An appeal is far more powerful than a review — it’s a full, independent hearing before an immigration judge at the First-tier Tribunal (Immigration and Asylum Chamber), where evidence and legal arguments are considered afresh.

Appeals are generally available where the decision engages your human rights — most commonly family visas (such as a spouse visa) refused on the basis of your right to family life (Article 8), as well as asylum and EU Settlement Scheme decisions. Most work, study and visitor visa refusals do not carry a right of appeal. We’ll confirm whether you can appeal and build the strongest possible case.

Judicial review

Where there’s no right of appeal or administrative review, it may still be possible to challenge a decision by judicial review — asking a court to rule that the Home Office acted unlawfully. This usually starts with a Pre-Action Protocol letter. Judicial review is a specialist area, and early legal advice is essential.

Sometimes a fresh application is the best route

Not every refusal is best challenged — sometimes the strongest move is a new, properly prepared application that fixes the reason you were refused. This is common with spouse visa refusals based on missing financial or relationship evidence. We’ll tell you honestly which route gives you the best chance.

Yes. In urgent cases, the court can make an order without the other person being told first (a “without notice” order), so you get immediate protection. There is then a follow-up hearing where they can respond. If you or your children are at risk, we act quickly to get the protection you need.

How long do I have to challenge a visa refusal?

Usually 14 days if you're in the UK or 28 days if you're outside the UK, from the date of the decision. The exact deadline is in your refusal letter. Missing it can cost you that route of challenge, so act quickly.

Can I appeal a spouse visa refusal?
