Is it "custody" or "child arrangements" now?

Both terms refer to the same thing, but the correct legal term has changed. In England and Wales, the courts no longer use the word “custody” — since 2014 the law uses a Child Arrangements Order, which sets out two things:

Who the child lives with (what people used to call “custody” or “residence”)
Who the child spends time with (what people used to call “access” or “contact”)Most people still search for “custody”, so we use both terms — but rest assured we work with the current law every day.

How does the court decide arrangements for children?

The court has one guiding principle: the welfare of the child comes first. There is no automatic rule that children live with their mother or their father. Instead, the court looks at what is best for the child, considering things like their needs, their wishes and feelings (depending on age), and any risk of harm.

The law also assumes that both parents being involved is good for the child, unless there’s a reason it wouldn’t be safe. In practice, this means fathers and mothers start from an equal footing.

Do you have to go to court?

Usually, court is a last resort. Most arrangements can be agreed through discussion or family mediation, which is faster, cheaper and far less stressful for everyone — especially the children. Before applying to court for most children matters, you’ll normally attend a Mediation Information and Assessment Meeting (MIAM) (cases involving domestic abuse are exempt).

LEGAL AID AND COSTS

For children matters, legal aid may be available where there is domestic abuse or a child protection concern. It is means-tested and merits-tested, and mediation is often funded even when other legal aid isn’t. We’ll check your eligibility at the outset.
